What it is
Florida Statutes §320.03(10)(d) provides that an authorized electronic filing system (EFS) agent may charge a fee to the customer for use of the electronic filing system. Florida Administrative Code Rule 15C-16.012(5) requires that if an EFS agent charges such a fee in a title or registration transaction, the fee must be disclosed separately and in a clear and conspicuous manner in the sales agreement along with the other options for titling and registration, and the agent may not disclose or disguise it as a state or government fee. FLHSMV’s Authorized Service Provider FAQ similarly states there is no state-approved fee beyond specified government charges for related electronic temporary-registration processes, and any additional dealer fee must not be represented as collected for the state. There is no fixed statewide dollar amount for the dealer EFS charge — the amount is set by the dealer/agent and can vary by store.
