Can I cancel GAP after I sign in Florida?

Yes, during the free-look period: Florida law gives you at least 30 days after a GAP contract takes effect to cancel it for a full refund. After that your contract decides, but when your loan ends early, Florida requires a refund of the unearned part unless the contract says otherwise, and you have 90 days to ask for it.

What GAP is

The CFPB describes GAP as “an optional product that is intended to cover the difference between the amount you owe on your auto loan and the amount the insurance company pays if your car is stolen or totaled” (CFPB). In Florida, GAP sold with a car loan “is not insurance for purposes of the Florida Insurance Code” (Fla. Stat. 520.02(7)). Its rules sit in the state’s car-finance law instead.

The free-look period: a full refund

Florida’s GAP law says GAP products “may be cancelable or noncancelable after a free-look period as defined in s. 520.152” (Fla. Stat. 520.07(11)(h)). Section 520.152(5) defines that period as the time, starting on the contract’s effective date, “during which the buyer may cancel the contract for a full refund of the purchase price,” and says it “may not be shorter than 30 days” (Fla. Stat. 520.152(5)). The Senate staff analysis of the bill that enacted these rules, CS/CS/SB 902 (ch. 2024-142), describes the same 30-day minimum (Fla. Senate analysis, CS/CS/SB 902; bill history). Your contract can give you longer.

When your loan ends early

Paying off the loan early ends the debt GAP protects, and that includes a payoff when you sell, trade in or refinance. GAP products “cease to provide any benefits when the loan is terminated,” the CFPB notes (CFPB Supervisory Highlights, Issue 35). Florida’s rule for a GAP contract that ends (Fla. Stat. 520.07(11)(g)):

  • The company providing the GAP product “shall refund to the buyer all unearned portions of the purchase price of the contract unless the contract provides otherwise.”
  • You must tell them about the event that ended the contract and request the refund “within 90 days after the occurrence of the event terminating the contract.”
  • They may deduct no more than $75 in administrative fees.
  • No refund is due if you received a benefit under the product, such as a paid claim.
  • A contract with no refund is allowed only if you were also offered “a bona fide option to purchase a comparable contract that provides for a refund.”

The CFPB agrees that “you may be entitled to a refund if you sell, refinance, or prepay your auto loan” (CFPB). Its examiners write that after an early payoff, “the full amount of the refund should go to the borrower,” and they found servicers that failed to make sure add-on refunds were paid, or miscalculated them, so check the amount (CFPB Supervisory Highlights, Issue 35).

When the GAP contract ends because of a default, a repossession or any other end of the loan, Florida lets the provider pay the refund to the holder of your contract or the administrator and apply it to what you owe, “unless the buyer can show that the retail installment contract has been paid in full” (Fla. Stat. 520.07(11)(i)).

Cancelling while you keep the loan

After the free look, a Florida GAP contract can be cancelable or noncancelable, so check its cancellation section. The CFPB’s general guidance is broader: “You have the right to cancel these optional add-on products at any time and reduce your costs” (CFPB). Read what your contract allows and what it refunds, and ask whether a refund comes to you or goes to the lender.

How to ask for the refund

  1. Find your GAP contract. Florida requires the company that provides the GAP product to give you a copy of the signed contract (Fla. Stat. 520.07(11)(e)). If you can’t find it, the CFPB suggests checking “with your lender, the provider, or the dealer you bought the car from.”
  2. Find who handles cancellations. The contract names the provider or administrator.
  3. Write to them well inside the 90 days. Include the loan account number, the VIN, the date the loan ended and the payoff letter, and ask for the refund amount and how it was figured.
  4. If the refund doesn’t arrive or looks wrong, you can submit a complaint to the CFPB. FLHSMV’s consumer page points GAP questions to the Florida Department of Financial Services and financing-contract complaints to the Office of Financial Regulation (FLHSMV).

The Packed Payment Detector shows what GAP adds to a monthly payment, and The finance office and dealer add-ons covers the other products sold alongside it.

What to say

“I’m cancelling my GAP contract within the free-look period. Please refund the full price.”
“My loan was paid off on [date]. I’m requesting the refund of the unearned GAP charge. Please send the amount and how you figured it.”
“Who administers this GAP contract, and where do I send a cancellation request?”
“Will the refund come to me, or go to my loan balance?”
“The refund is less than I expected. What dates and formula did you use?”
